1) Definitions
- Equipment – Any item hired from us, including attachments, accessories, trailers, tools, and consumables.
- Hire Period – The period from when equipment leaves our yard until it is returned and accepted back.
- Rate – The daily/weekly hire fee, plus any additional charges.
- Damage – Any loss, breakage, malfunction, misuse, or cleaning required above normal wear and tear.
- Site – The location where equipment will be used or delivered.
- Customer – The individual or business hiring equipment.
2) Hire Conditions
- Equipment is hired on a daily/weekly rate unless otherwise agreed in writing.
- The hire period continues until equipment is returned and checked off by us.
- Minimum hire charges may apply.
- Booking dates and availability are not guaranteed until confirmed by us.
3) Delivery & Collection
- Delivery and pickup can be arranged at an additional cost.
- Delivery times are estimates only.
- You must ensure the site is accessible and safe for delivery vehicles.
- If the site is inaccessible or causes delays, waiting time or additional delivery fees may apply.
4) Customer Responsibilities
You agree to:
- Use equipment only for its intended purpose.
- Operate equipment safely, responsibly, and in accordance with instructions.
- Ensure operators hold any required competency, licence, or certification.
- Keep equipment secure, protected from theft, weather, or misuse.
- Allow only competent persons to operate the equipment.
- Comply with all workplace health and safety laws.
- Notify us immediately if equipment is damaged, lost, stolen, or malfunctioning.
5) Damage, Loss, and Cleaning
You are responsible for:
- Any loss, theft, or damage (regardless of fault) while equipment is in your care.
- Repairs, replacement costs, and downtime charges.
- Excessive cleaning, including removal of concrete, mud, paint, or contaminants.
- Tyre damage caused by punctures, cuts, blowouts, or misuse.
If equipment is damaged beyond repair, you must pay the full replacement value.
6) Breakdown & Faults
- If equipment breaks down due to a defect not caused by misuse, we will repair or replace it as soon as reasonably possible.
- Your obligation to pay hire charges is suspended only for the period the equipment is unusable due to our fault.
- We are not liable for delays, loss of income, or project downtime caused by equipment failure.
7) Theft or Loss
- You must immediately report any theft to us and to the police.
- You remain liable for the replacement cost unless otherwise agreed in writing.
- Insurance (if offered) must be accepted before the hire period – not after loss occurs.
8) Fuel, Consumables & Maintenance
- Equipment must be returned with the same fuel level it was supplied.
- Additional charges apply for refuelling.
- Daily checks (oil, water, grease, batteries, tyres) are the hirer’s responsibility.
- Consumables (e.g., teeth, blades, filters, hoses) may incur extra charges.
9) Hire Rates & Additional Charges
You may be charged for:
- Late return
- Cleaning
- Refuelling
- Damage or replacement
- Delivery and pickup
- After-hours call-outs
- Stand-down or waiting time
- Excess hours if equipment exceeds standard daily hour limits
10) Payment Terms
- Payment terms are as per your approved account or otherwise strictly prepaid.
- Overdue amounts may incur interest or late fees.
- All recovery, legal, and debt collection costs are payable by the customer.
11) Termination of Hire
We may terminate a hire immediately if:
- You breach these terms
- Equipment is used unsafely
- Payment is overdue
- Equipment is at risk of damage or seizure
Upon termination, equipment must be returned immediately, or we may enter the site to recover it.
12) Liability & Indemnity
- You indemnify us against all loss, damage, injury, claims, or costs arising from your use of the equipment.
- We are not liable for indirect or consequential loss, including delays, business losses, or inconvenience.
- Nothing in these terms limits any rights you have under Australian Consumer Law.
13) Title & Ownership
- We retain ownership of all equipment at all times.
- You must not sell, sub-hire, mortgage, or transfer the equipment.
- Equipment may not leave the state/region without prior written approval.
14) Insurance
Where applicable:
- You may be required to maintain insurance for the equipment while in your care.
- Proof of insurance must be provided upon request.
- Insurance does not cover negligence, misuse, or unapproved operators.
15) Privacy & Credit Terms
- Personal and business information collected during the hire process is used to manage your account and assess hire suitability.
- For account customers, your information may be checked with trade references.
- Our Account Reporting Policy applies.
16) Governing Law
These terms are governed by the laws of the state or territory in which the hire occurs.
